Abstract: Environmental audits have become an essential component of an adequate environmental compliance program as regulatory complexities multiply, statutory penalties increase, and public scrutiny intensifies. Audits identify problems so they can be corrected before they are cited as violations or become public emergencies. To minimize the risk that sensitive information will be disclosed before corrections can be made, the audit program should be structured from its inception so that the information it generates is subject to the attorney-client privilege. An ongoing program that provides for prompt remediation of whatever discrepancies are uncovered can nevertheless be operated with minimal attorney involvement.
