Abstract: I would like to discuss three things with you today. First, the dramatic increase in environmental enforcement - especially criminal enforcement - and the tough sanctions which can be imposed, both organizationally and individually, for environmental violations. These require high level corporate attention to minimize the risks of individual and corporate criminal liability. Second, the increasing importance given corporate compliance programs by the government in deciding whether to prosecute for environmental violations and in the punishment that may be imposed for such violations. And, third, what features are needed - according to the government - for a corporate compliance program to achieve the maximum benefits for the corporation in terms of minimizing the risk of prosecution and of any punishment imposed.
